Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her order, the court noted that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The court proceedings involve conflicting claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
