Michael Jordan Tells Court He ‘Wasn’t Afraid’ of Nascar in Antitrust Trial
Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, admitted that his competitive side and status as a newcomer motivated his effort with 23XI Racing to “challenge” Nascar over perceived violations of competition laws.
Financial Stakes and a Competitive Drive
Jordan shared financial and corporate details of his racing venture, revealing he put in $40m of his personal wealth into the Nascar Cup series team launched with business partner Curtis Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar as a whole. From my perspective, the sport required examination through a new lens.”
Central Issue: Charter Agreements and Contract Pressure
At issue is the expiration of a 2016 deal where Nascar granted each team a “charter”. This system mirrors other professional sports with separately owned franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was due to end in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with onlookers and reporters clamoring for a view or a picture of the sports legend.
Spearheading the Fight
Jordan’s 23XI is leading the full-court press along with another racing team for Nascar to change a business model Jordan said is unlawful to maintain excessive control.
At issue for Jordan and Heather Gibbs, who preceded Jordan, are events from September 2024. She recounted a hectic and tense six hours where the racing circuit told teams they had to sign a charter agreement extension. This agreement spanned 112 pages outlining pay for chartered teams and a guaranteed spot in every race.
Choosing Litigation
Jordan explained that 23XI and Front Row Motorsports decided their sole viable path was to refuse a signature that 112-page package and litigate the matter. All other teams agreed to the terms.
Jordan and co-owner Denny Hamlin approached Nascar about potential amendments or extension options. Nascar refused to engage, according to his testimony.
The Bottom Line: Victory
Ultimately, the pushback against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.
“Denny convinced me getting a third driver boosted our odds of winning,” he testified, sharing that he purchased another franchise last year for $28 million despite the uncertainty. “So I dove in.”

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the contract signing demand didn’t sit well.
She said, the team founder first tried to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.
“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. The response was, “Whether I have 20 charters, I have 20. If I have 30, that’s the number.”
